Judge to rule soon on appeal dismissal in Prieto death row case

U.S. District Court Judge Henry E. Hudson said Wednesday that he hopes to rule in two to three weeks on a request to dismiss the appeal of Virginia death-row inmate Alfredo R. Prieto.

In what Hudson said is an important case, Prieto, under death sentences in Virginia and California, contends he cannot be executed because he is intellectually disabled and argues a recent U.S. Supreme Court decision supports his claim.
