In execution of a certain Deed of Trust dated June 12, 2006, in the original principal amount of $96,300.00 recorded in the Clerk's Office, Circuit Court for Powhatan County, Virginia, in Book 689 at Page 595 as Instrument No. 060004065 . The undersigned Substitute Trustee will offer for sale at public auction in the front of the Circuit Court building for Powhatan County, Virginia, 3880 Old Buckingham Road, Powhatan, Virginia on July 8, 2019, at 5:30 PM, the property described in said Deed of Trust, located at the above address, and more particularly described as follows: ALL THAT CERTAIN PIECE OR PARCEL OF LAND, WITH IMPROVEMENTS THEREON AND APPURTENANCES THERETO BELONGING, LYING AND BEING IN SPENCER DISTRICT, POWHATAN COUNTY, VIRGINIA, AND DESIGNATED AS LOT 6A AND LOT 6B, SAINT TIMOTHY WOODS, AS SHOWN ON PLAT OF SURVEY PREPARED BY WOODROW K. COFER, INC., CERTIFIED LAND SURVEYOR, DATED FEBRUARY 4, 1989, WHICH PLAT IS RECORDED AMONG THE LAND RECORDS OF POWHATAN COUNTY, VIRGINIA, IN DEED BOOK 208, PAGE 326, TO WHICH PLAT REFERENCE IS HEREBY MADE FOR A MORE PARTICULAR DESCRIPTION OF THE LAND HEREBY CONVEYED. LOT 6B DESCRIBED ON THE PLAT REFERENCED ABOVE MAY NOT BE IMPROVED OR BUILT UPON AND DOES NOT MEET POWHATAN COUNTY MINIMUM LOT REQUIREMENTS FOR DEVELOPMENT. TERMS OF SALE: ALL CASH. A bidder's deposit of ten percent (10%) of the sale price or ten percent (10%) of the original principal balance of the subject Deed of Trust, whichever is lower, in the form of cash or certified funds payable to the Substitute Trustee must be present at the time of the sale. The balance of the purchase price will be due within fifteen (15) days of sale, otherwise Purchaser's deposit may be forfeited to Trustee. Time is of the essence. Substitute Trustee has identified an unreleased security instrument which may be superior to the subject deed of trust. Substitute Trustee disclaims any implication that the Property will be sold free and clear of all liens. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled to a return of the deposit paid.
