Authorities in Nottoway County expect to file a charge of unauthorized use of a motor vehicle against Lt. Joshua P. Yabut, with the Army National Guard.

On Tuesday evening, Yabut, 29, of Richmond, allegedly drove an armored personnel carrier 60 miles from Fort Pickett in Nottoway to downtown Richmond.

He was charged in Richmond with the unauthorized use of a vehicle, driving under the influence and eluding police.

Terry J. Royall, the Nottoway commonwealth’s attorney, said Friday that she will seek an indictment against Yabut for unauthorized use of a motor vehicle at the next grand jury meeting July 3.

If that happens, she said, the Richmond unauthorized use charge would be dropped.

The charge is a felony punishable by up to five years in prison.

No bond has been set for Yabut, who initially had been held at the Richmond City Jail but who The Associated Press has reported was at Central State Hospital.
